Terms of Use
1. What this is about
ShaveIndex is a free reference for wet shaving products operated by Roman Pustina, Vienna (see Legal Notice).
These Terms govern the use of shaveindex.com and its member features. The provisions concerning advertising and newsletters also apply, where relevant, to the ShaveIndex newsletter.
You do not need a member account to use the public catalogue. By creating a member account and agreeing to these Terms, you enter into a free user agreement for the member features of ShaveIndex.
2. The catalogue
You may use the catalogue free of charge. The information comes mainly from makers and other publicly available sources. We make reasonable efforts to collect and organise it carefully, but we cannot guarantee that all information is correct, complete and up to date at all times.
The maker's current information and the product packaging are authoritative – especially regarding ingredients, directions for use and allergens. If this information is important to you, please check it yourself before using a product.
Scent notes describe scent impressions and fragrance characteristics and are not an ingredient list. If a scent note or other piece of information is missing, this does not mean that a particular ingredient or component is absent.
Tools such as the Scent Finder and Base Finder show similarities based on information recorded by ShaveIndex. They do not promise that two products smell the same, feel the same or are suitable for the same people.
ShaveIndex does not sell any of the products shown in the catalogue. If you buy a product from a maker or retailer through a link, the purchase contract is solely between you and that provider.
3. Advertising, sponsored listings and partner links
ShaveIndex is free for you and may be financed through advertising and partner programmes.
This means that:
- links to makers or retailers may be partner links (affiliate links) for which we may receive a commission if a purchase is made; your price does not change;
- sponsored listings, sponsored links and advertisements may appear on the website;
- newsletters may contain paid advertising, sponsored content and partner links.
The following applies:
- Paid or sponsored content is identified as "Ad", "Sponsored", "Partner link" or with a similarly clear label.
- Commercial arrangements do not alter catalogue information or ratings.
- Paid placements do not influence the order of non-sponsored results; sponsored placements are identified as such.
- Advertising is generally selected according to the content of the relevant page or newsletter issue and not according to a personal advertising profile.
- Services that require cookies, similar technologies or personal profiles for advertising are only used where the legally required consent has been obtained.
Further details about the processing of personal data are provided in the Privacy Policy.
4. Your account
- A member account is personal. Please create only one account and use an email address that belongs to you and to which you have access.
- Your sign-in code and – if you set one – your password are for you alone. Do not share them with other people.
- Your username may be publicly visible where a feature provides for this, for example in the public change log for accepted corrections. Your email address is not displayed publicly.
- Your username must not insult or harass anyone, deceptively impersonate another person or organisation, infringe the rights of others or be used for unauthorised advertising. We may reject an inappropriate username or require you to change it.
- You can delete your account at any time under "My account". Deletion is final and cannot be undone. The Privacy Policy explains which data are deleted and which information may remain for legal or factual reasons.
- If you delete your ShaveIndex account, any existing newsletter subscription is cancelled at the same time.
5. Rules for contributions and messages
Whenever you submit content through ShaveIndex – for example suggestions to improve information, submissions of products or makers, messages to the team or messages through the contact form – the following applies:
- be factual and respectful; insults, threats, discrimination, harassment and similar attacks are not permitted;
- no unauthorised advertising, spam or links to harmful or unlawful content;
- do not publish or submit another person's personal data without appropriate authority;
- do not submit anything that infringes copyright, trademark rights, personality rights or other rights of third parties;
- do not knowingly make false or misleading statements about products, makers or other people or businesses;
- corrections and submissions should be based on a comprehensible and verifiable source.
Contributions intended for the catalogue are reviewed before publication. We may reject, withhold or remove contributions that breach these Terms, are clearly inaccurate or do not fit the catalogue for other objective reasons.
6. Ratings
- Only rate products and scents that you have personally used, and give your own experience.
- As a rule, each member may have one current rating for each product or scent. You may change your rating; changes may be reviewed again.
- If you have a commercial or personal connection with a maker or retailer – for example as an owner, employee, representative or because you receive a benefit for a rating – you must not rate its products.
- Ratings are displayed publicly only in aggregated form, in particular as an average.
- Ratings are not weighted more or less heavily because of your level, points or badges.
- Makers, retailers, advertising partners and other third parties cannot buy ratings or pay to have them changed.
We may reject ratings or remove them from the calculation where there are reasonable indications of manipulation, multiple accounts, conflicts of interest or other breaches of these Terms.
7. Corrections, submissions, points, levels and badges
Suggestions to improve information and submissions of products or makers are reviewed by us. Accepted corrections may become part of the catalogue and may appear in the public change log together with your username, the changed field and the new value. An accepted submission may result in a new catalogue entry.
Certain activities on ShaveIndex may earn or unlock points, contributor points, levels, badges or avatar figures. Daily or other reasonable limits may apply to individual activities.
The activities that currently qualify, the number of points awarded and the applicable limits are shown within ShaveIndex or in your account. We may adjust these rules for future activities, in particular to prevent abuse, keep the system balanced or accommodate new features.
Points that were properly earned will not be removed retroactively solely because we later change the rules. We may, however, correct or withdraw points that were awarded because of an error, a reverted submission, manipulation, multiple accounts or a breach of these Terms.
Points, levels, badges and avatar unlocks are forms of recognition within ShaveIndex. They are not payment, have no monetary value, cannot be cashed out or transferred and do not give rise to any claim for payment or other economic benefit.
8. Rights in your contributions
Where rights exist in content that you submit for the ShaveIndex catalogue, those rights generally remain yours.
To enable us to use accepted contributions permanently within the catalogue, you grant us a royalty-free, non-exclusive, worldwide and perpetual licence to use them to the extent necessary to operate, display, document and further develop ShaveIndex.
This includes, in particular, the right to store, reproduce and make catalogue contributions publicly available and to edit, structure, shorten or translate them for presentation purposes without distorting their substantive meaning.
This provision applies in particular to accepted corrections and submissions. Factual catalogue information and accepted changes may remain part of the catalogue and its change log after your account has been deleted; your username will be replaced or anonymised as described in the Privacy Policy.
This licence does not apply to your private notes, private collection, private SOTD information, messages to the ShaveIndex team or contact enquiries. The processing and deletion of those data are governed by the Privacy Policy.
Please only submit content that you created yourself or that you are entitled to use and provide to us.
9. Newsletter
The ShaveIndex newsletter is an optional additional feature for members with a ShaveIndex account. A newsletter subscription is not required in order to create or use a ShaveIndex account.
You only receive the newsletter if you request it yourself through your account and confirm your subscription through the double opt-in process.
The newsletter may contain the paid or sponsored content and partner links described in section 3.
We use Brevo to send and technically manage the newsletter. Details about the processing of newsletter data and any separately consented newsletter statistics are provided in the Privacy Policy.
You can unsubscribe from the newsletter at any time and free of charge through the unsubscribe link in every issue or in the signed-in area under "My account". Unsubscribing from the newsletter alone does not delete your ShaveIndex account or restrict your use of it.
If you delete your ShaveIndex account, any existing newsletter subscription is cancelled at the same time and with immediate effect.
10. What is not allowed
Without our prior permission, the following is prohibited in particular:
- automatically extracting the catalogue or substantial parts of it, including through scraping, bots, crawlers or mass automated queries, unless such use is expressly permitted by law;
- circumventing technical protection measures or access restrictions;
- automatically or repeatedly submitting forms, ratings, corrections or submissions;
- using another person's member account or access credentials;
- creating multiple accounts in order to manipulate points, ratings, limits or other features;
- transmitting malware, harmful code or other content that may endanger the operation of the service;
- using ShaveIndex in a way that materially disrupts, overloads or endangers the service, servers or other users.
We may allow access by generally recognised search engines to the extent technically intended.
11. Closed beta
During a closed beta, parts of ShaveIndex may only be available to members with the appropriate beta access.
Beta features are still under development. They may change, be temporarily unavailable or be removed again. Information and features may still be incomplete or inaccurate during a beta.
A personal beta access or invitation code must not be sold or distributed publicly unless the invitation expressly provides otherwise.
You can send feedback about the beta through the available messaging and contact features.
12. Suspension, changes and termination of the service
In the event of serious breaches of these Terms, attempted manipulation, security risks or unlawful use, we may temporarily restrict an account or individual features or, where necessary and proportionate, terminate the account.
For less serious or remediable breaches, we will generally notify you of the problem first and, where reasonable, give you an opportunity to correct it. Measures may be taken immediately in the case of urgent security issues, obvious abuse or unlawful content.
If you believe that a restriction or other measure was unjustified, you can contact us at contact@shaveindex.com or through the contact form.
We may develop, change or replace ShaveIndex and individual features for objective reasons, for example because of technical development, security, abuse prevention, legal requirements or changes to the service. Where possible, we will give advance notice of material changes that significantly affect the use of a member account.
We may also discontinue the free service or substantial parts of it. Unless urgent technical, legal or security reasons prevent this, we will give registered members reasonable advance notice and allow them to export the data made available for that purpose before discontinuation.
Mandatory statutory rights remain unaffected.
13. Liability
The information in section 2 applies to the accuracy, completeness and currency of catalogue information. ShaveIndex is a reference service and, particularly in relation to ingredients, allergens, use and product safety, does not replace current information provided by the maker or on the product packaging.
Otherwise, the statutory liability rules apply.
We are liable without limitation for damage caused intentionally or by gross negligence and for injury to life, body or health.
Liability for slight negligence is limited or excluded only to the extent permitted by applicable law. Mandatory liability, warranty and other consumer rights remain unaffected in all cases.
The respective operators are responsible for the content and services of external websites, makers, retailers and other providers to which ShaveIndex merely links. This also applies to offers from advertising or affiliate partners. Any statutory responsibility of ShaveIndex itself remains unaffected.
14. Changes to these Terms
We may amend these Terms where ShaveIndex, its features or the applicable legal framework changes, or where an amendment is necessary for security or abuse-prevention purposes.
Every version carries a version number and a date.
Where a new version is intended to apply to an existing user agreement, we will ask you to expressly agree to it the next time you visit the member area. Until you agree, features for which the new Terms are required – in particular the submission of new contributions or ratings – may be restricted.
If you do not agree to a new version, you can still use the available account-management functions, download the data made available for export and delete your account.
Changes to these Terms do not apply retroactively to completed activities unless mandatory legal requirements require otherwise.
15. Governing law and jurisdiction
Austrian law applies.
If you are a consumer whose habitual residence is in another country, this choice of law does not deprive you of the protection of mandatory provisions that would apply under the law of that country in the absence of this choice. The statutory rules on jurisdiction apply to consumers.
For disputes with businesses, Vienna is agreed as the exclusive place of jurisdiction to the extent permitted by law.
